OBJECT OF THE CONTRACT
These general terms and conditions govern the purchase of products or services made remotely via telematic means by Simon Bart Gallery S.r.l., headquartered at Piazza Cavour 6/E - 40124, Bologna. Each purchase transaction will be regulated by the provisions of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), particularly Section II, Part II, Title III on distance contracts, as well as by the provisions of Legislative Decree no. 196 of 30 June 2003 regarding the protection of personal data.
PURCHASE ORDER AND FORMATION OF THE CONTRACT
The contract is considered finalized when the Supplier Company receives the purchase order sent by the Customer through the website www.simonbart.com for the selected products and/or services. Submitting the online order implies the Customer's full acknowledgment and acceptance of these general terms and payment conditions. The Customer confirms that they have reviewed all the information provided during the purchasing process.
If the Customer is a consumer (i.e., an individual acting for purposes unrelated to business, commercial, artisanal, or professional activities), they must print, save, or otherwise retain a copy of these sales conditions at the end of the purchase process, as required by Articles 52 and 53 of Legislative Decree no. 206/2005 on distance contracts. Any right of the Customer to claim compensation for damages or indemnities, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, arising from the non-acceptance, even partial, of an order, is expressly excluded.
PURCHASE METHODS
Products and services offered for sale on the website www.simonbart.com are provided at the prices displayed, which must be confirmed at the time of order confirmation, along with shipping costs. Before finalizing the purchase, a detailed summary of the total cost of the selected products or services, including transport expenses, will be provided.
PRICES AND PAYMENT METHODS
Payment for purchased products and services, including related shipping costs, must be made using one of the following methods selected during the order process: Credit Card or Bank Transfer in Advance.
PRODUCT DELIVERY AND SHIPPING COSTS
The delivery of products will be carried out according to the option selected by the Customer:
- Free pickup by the Customer at Simon Bart Gallery’s premises located at Piazza Cavour 6/E, Bologna;
- Courier service – delivery will be made to the address provided by the Customer for shipment.
At the time of delivery, the Customer must verify the integrity of the package and ensure it is neither damaged nor wet. Only after this verification should the Customer accept the delivery. If the contents of the package are found to be damaged, the Customer must contact Simon Bart Gallery within 24 hours of delivery, providing photos that clearly show the damage in order to request reimbursement through insurance.
ORDER PROCESSING TIME
The processing times specified on product information pages are approximate and not binding. However, the Supplier Company will strive to process orders as quickly as possible, in line with the production times of the products or the execution of purchased services. The Company is not responsible for any delays caused by national couriers due to external factors or force majeure. The Customer acknowledges that order processing times vary depending on the type of work and the quantity requested.
For purchased services, it is the Customer's responsibility to provide all required materials as specified in the product details. The Company cannot process the service until all materials are received in full and in the manner indicated in the product description.
RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the contract concluded with the Seller, without any penalty or obligation to provide a reason, within 10 working days from the date of receipt of the products purchased on www.simonbart.com. To exercise the right of withdrawal, the Customer must send an email to info@simonbart.com and wait to receive the return form, which will be emailed to the Customer. Once the Customer has received the form, they can proceed with the return shipment. Returns sent without explicit authorization and without the Company’s return form will not be accepted. The Customer assumes the costs and risks of the return shipment. After the return has been received at the warehouse located at Piazza Cavour 6/E, Bologna, the Company will issue a refund within 10 working days.
For purchased services, the right of withdrawal cannot be exercised if the Customer has provided incomplete material required for the service execution.
JURISDICTION
For any disputes regarding the interpretation or execution of the contracts, the exclusive jurisdiction will be that of the Court of Bologna.
